7 Bankruptcy New Laws

For those planning to file Chapter 7, new laws went in effect in October of 2005 that limit who can file as well as how you can file. Chapter 7 bankruptcy is a form of bankruptcy in which debtors may obtain a total discharge of their debts. This means that they do not have to repay this debt if the debts receive discharge through the courts. Under new laws, there are new stipulations on the process. The process has become more complex in that if an individual fails to meet guidelines or they miss filing requirements, the case may receive dismissal by the court and the debts will not receive a discharge. Therefore, it is highly recommended that individuals use the services of an attorney to file Chapter7 bankruptcy. Though not required, the U.S. Courts claim that filing for bankruptcy on your own is extremely difficult to do successfully.
