Bankruptcy Filing Fee

In order to file bankruptcy, a bankruptcy filing fee must occur at the time of submission of the bankruptcy petition. This fee pays only for court services, not attorneys. Attorney fees are in place by the attorneys themselves and payment must occur in advance of the filing in most cases. For those filing Chapter 7, fees for court services are $299. For those filing Chapter 11 bankruptcy, total fees are $1039. For those filing Chapter 12 bankruptcy, filing fees are $239. Chapter 13 filing fees are $274. These fees are in place since April of 2006 and are subject to change from time to time. There may be additional fees associated with local court regulations and state laws. This information is readily available to you by requesting it from your attorney or from the bankruptcy court ahead of filing.

Fast Facts

  • These fees must occur prior to the bankruptcy petition being filed, and there is no method for filing bankruptcy for free.
