Eligible For Chapter 7

You may be eligible for Chapter 7 bankruptcy relief if you have a moderate income and a fair amount of dischargeable debts relative to your income. A debtor generally is eligible for Chapter 7 relief if their income is lower than the median income for a family of like size in the debtor's state of residence. If a debtor's income is higher than the appropriate median income, however, the debtor must have his financial situation assessed under the means test, which measures the debtor's ability to repay debts after certain deductions and allowances. The means test is a relatively complicated formula that helps determine whether a debtor is eligible for Chapter 7 bankruptcy proceedings. If a debtor meets the requirements of the means test, in that he or she is unable to realistically repay outstanding debts, then the debtor may seek a debt discharge through Chapter 7.
