File A Bankruptcy

To file a bankruptcy, individuals or married couples have two options. They can work with an experienced attorney specializing in bankruptcy law or they can file for bankruptcy themselves. The process is lengthily and depending on which type of bankruptcy files, it can take between six months and three years to complete. Individuals who file themselves must meet the stringent demands of the bankruptcy court to process the bankruptcy. To file a bankruptcy, all debts must have an outline on specific forms and lenders must receive contact. The process involves a discharge of all debt, only if filing Chapter 7 bankruptcy. If filing Chapter 13 bankruptcy, this allows all debts to have reorganization to allow for easier repayment. All bankruptcy filings must have approval by the court system. This occurs through a hearing and later a judge will make final ruling on the process. If the individual hires an attorney to handle the bankruptcy proceedings, they may not have to appear in court, but will need to appear at the special hearing.
