Filed Bankruptcy In The Last 6 Years

Generally, if you have filed bankruptcy and received a discharge of your debts, you are not eligible to file again until a period of six years has passed. However, if your bankruptcy was dismissed for any reason, and you did not receive a discharge of your debts, you can file bankruptcy again after a period of 180 days has passed. Thus, if you have filed bankruptcy in the last six years, you will want to be cautious about filing bankruptcy again, in that you should ensure that you are eligible to do so before you complete all the paperwork necessary to do so. Time limits do vary to some degree based upon the type of bankruptcy filed, so you should definitely consult an attorney if you are unsure as to your eligibility for filing a subsequent bankruptcy action.
