Filing for Chapter 7 bankruptcy is a right that every American has under federal law. That does not mean that everyone should file for bankruptcy. Chapter 7 bankruptcy allows an individual to file for total discharge of all included debts. If after the filing of the bankruptcy is successful, a hearing will occur to ensure that, the meeting of the creditor's rights occurs. After this, it is up to a judge to approve the bankruptcy and then to formally discharge the debts. This process can take several months and is only official once official discharge paperwork goes to the debtor from the courts.
