Take The Means Test

In order to determine eligibility for Chapter 7 bankruptcy proceedings, or debt liquidation, a debtor and his or her household must take the means test, which involves measuring household income against the median household income for a family of the same size. The means test is a rather complicated formula that includes evaluation of all household income and expenses. As a result of the newly enacted requirement that all debtors take the means test in order qualify for Chapter 7 bankruptcy relief, many debtors are no longer eligible to file Chapter 7 bankruptcy at all. The theory is that debtors who have sufficient household income should not be entitled to completely discharge all eligible debts, but, rather, should be required to pay back at least a portion of their debts, since they are financially able to do so.
