How to find out if your bankruptcy has been discharged

Hi. This might be a stupid question, but how will I know that my bankruptcy has been discharged, after it’s discharged? Thanks.

It’s not a stupid question at all, but a very important one. Fortunately, it has a very easy answer: the court will tell you. Once a debtor’s debts are discharged at the successful completion of the bankruptcy process, the clerk of the bankruptcy court will mail discharge papers to:

  • All creditors (at least all the ones identified in the bankruptcy)
  • The U.S. trustee
  • The trustee in the case
  • The trustee’s attorney
  • The debtor
  • The debtor’s attorney

If you somehow miss your papers, if you have an attorney representing you—always recommended—he or she will receive them and be able to let you know that you have your discharge.
