In general, employees are not required to inform their employer that they are filing for Chapter 7 bankruptcy, as they do not have to make payments into a plan. However, there are circumstances requiring the employee to notify his or her employer or that the court do so. First, employees must inform their employer that they have filed Chapter 13 bankruptcy when a wage withholding order has been entered against them as part of their bankruptcy filing. Also, when a court orders a planned debt repayment under Chapter 13 bankruptcy, it does so via voluntary wage garnishments, which must be communicated to the employer. It is unlawful for an employer to fire an employee for having filed for bankruptcy. Pursuant to the Bankruptcy Code, "No private employer may terminate the employment of, or discriminate with respect to employment against, an individual who is or has been a debtor under this title, a debtor or bankrupt under the Bankruptcy Act, or an individual associated with such debtor or bankrupt."
