Question:

Does chapter 7 in Idaho cover medical bills?

Answer:

Chapter 7 bankruptcy in Idaho generally will cover medical bills. Medical debts are considered, in almost every situation, as a type of unsecured debt. In other words, they are viewed more like credit cards and personal loans than like car loans or mortgage loans. The reason they are considered unsecured debt is because there isn't any collateral or security interest that the medical bill provider you owe money to can repossess. He can't come back and take back the treatment, after all, like a mortgage lender could take back the house.  Medical bills also aren't afforded any special protections that excludes them from bankruptcy, like student loans or back child support payments are.  This means that medical bills will be eligible for discharge in a chapter 7.

So, what happens to your medical bills during a chapter 7 bankruptcy?

  • You first need to turn over all non-exempt assets, which will be sold in a bankruptcy sale
  • Money generated from the bankruptcy sale, as well as money you had to turn over from bank accounts or savings accounts, will be distributed by the bankruptcy to the creditors according to the weight that the law assigns their claims (i.e. some creditors have a higher priority to collect than others do)
  • Any balance on your medical bills (as well as any balance on other eligible debt like credit cards) is then forgiven and becomes uncollectible.

Before filing for a chapter 7, you need to consult with a lawyer to determine if you qualify and to assess what impact the bankruptcy will have on your debts. Your lawyer will also help you throughout the entire filing process.
