What is exempt from bankruptcy in Oklahoma?

Answer:

Oklahoma only allows you to claim state bankruptcy exemptions if you want to keep your personal property including your home, car and jewelry. The value of the property must not exceed the exemption values. Oklahoma major state exemptions include the following: 

  • Real property or manufactured home to unlimited value; property cannot exceed 1/4 acre. If the property exceeds 1/4 acre, you may claim $10,000 on 1 acre in city, town or village, or 160 acres elsewhere (need not occupy homestead to claim it exempt aslong as you don't acquire another).
  • Household and kitchen furniture used for personal, family or household use.
  • Wedding and anniversary rings up to $3,000.
  • Implements of husbandry necessary to farm the homestead.
  • Personal books, portraits and pictures.
  • Clothing up to $4,000.
  • Motor vehicle up to $7,500.
  • Health aids.
  • 5 milk cows and their calves under 6 months old; 100 chickens; 2 horses and 2 bridles and 2 saddles 10 hogs, 20 head of sheep; all provisions and forage on hand, or growing for home consumption, and for the use of exempt stock for one (1) year.
  • Tools of trade up to $5,000. 

Under the bankruptcy laws enacted in 2005, you must take a credit counseling course from an approved Oklahoma credit counseling service six months prior to filing, and complete a debtor education course from an approved Oklahoma debtor education agency prior to receiving a discharge.
