Filing a bankruptcy will not cause your creditors to sue you. In fact, creditors cannot sue you when you file bankruptcy as an automatic stay goes into effect preventing your creditors from even contacting you until your bankruptcy is discharged or the stay is lifted. However, before a bankruptcy is filing, if you’re not paying your bills, some of your creditors may start suing you and this may lead to a garnishment of your paycheck. Therefore, it is advised to file bankruptcy as soon as possible so that creditors do not have enough time to sue you and possibly gain access to your paycheck and/or bank account.
