Getting Compensation for Articles Left in a Repossessed Car

Did you know that if your car is repossessed you have the right to get compensation for anything that may have left in the car?  According to the Federal Trade Commission, your creditor (for the car) has to tell you what personal items that you left in your car.  The creditor must tell you what you left and how and where you can get your personal effects back.

The Law on Items in a Repossessed Car

Believe it or not, your creditor cannot just have anyone take what they see in your car even though it has been repossessed.  A car creditor is tasked with employing a certain amount of reasonable care when it comes to removing your personal items from the car.  In the event that the car creditor, institutes a “don’t ask, don’t tell” policy when it comes to the personal items that you left in your car, then you just might have a lawsuit.

How to Recover Your Items

In the event that your creditor is unable to account for any personal items that you left in your car, then you will need to take a few crucial steps.

  • First, make a list of everything that you left inside of your car, and assess the value of each of those items.  For example, if you left a laptop and an ipod in your car that was repossessed, then you should go online and find similar models of your laptop and ipod.  Write down the retail price next to those items.  This is how you will need to itemize the personal effects that you left inside of your car.
  • Second, after you have assessed the inherent value of each item, then you should type it up neatly.  You might even consider getting the finalized document notarized so that you can use it in court.
  • Third, you should schedule an appointment with attorney.  During this meeting you will want to bring up the notion of your right to compensation for the articles left in your car.  Tell the attorney that your car was repossessed and that your creditor would not account for the items listed on your notarized sheet.   You should ask whether or not the state in which you live offers compensation for personal items seized in a repossession.  Additionally, you should ask about the process (how long will it take) for beginning proceedings against the car creditor for removing your personal effects without your knowledge.

Getting Help

Meeting with an attorney will better help you understand the repossession process and how it will affect you in the long run. With the help of an attorney, you should be able to get your items back faster and more efficiently as your attorney can help you to make your arguments and get in touch with the right people to help you.
